We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (‘the Privacy Act’), which govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including job applications, interviews, correspondence, by telephone, by email, via our website www.sculpt.group, from your website, from media and publications, and from other publicly available sources including registration boards and third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing.

Information we Collect

We collect personal information from candidates for the primary purpose of assessing suitability for employment opportunities and facilitating the recruitment process. This includes:

  • Curriculum Vitae, portfolio, and employment history

  • Qualifications, licences, certifications, and professional memberships

  • References and referee contact details

  • Right to work status and visa documentation (where applicable)

  • Salary expectations and employment preferences

  • LinkedIn profile and other publicly available professional information

  • Notes from interviews, candidate assessments, and screening conversations

We collect personal information relating to client contacts for the purpose of managing our business relationship and fulfilling recruitment briefs. This includes:

  • Contact names, job titles, email addresses, and phone numbers

  • Business name, address, and billing information

  • Details of role requirements, organisational structure, and hiring preferences

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union, criminal record, health information, and certain other categories.

In the course of recruitment, sensitive information may occasionally be relevant — for example, where a role has specific health, security clearance, or equal opportunity requirements. Sensitive information will only be used by us:

  • For the primary purpose for which it was obtained

  • For a secondary purpose that is directly related to the primary purpose

  • With your explicit consent; or

  • Where required or authorised by law

We will not collect sensitive information unless it is reasonably necessary and we will always seek your consent before doing so.

Disclosure of Personal Information

As a recruitment agency, sharing candidate information with prospective employers is a core part of what we do. We will always seek your consent before submitting your details to a client organisation. Outside of this, your personal information may be disclosed in the following circumstances:

  • To client organisations, with your prior consent, for the purpose of assessing your suitability for a specific role

  • To referees you have nominated, for the purpose of conducting a reference check

  • To third-party service providers who support our business operations including our applicant tracking system, cloud storage, telephony, and email platforms, subject to confidentiality and data handling obligations

  • To government agencies or regulatory bodies where required or authorised by law

  • To other parties where you have consented to the disclosure

We do not sell, rent, or trade personal information to or with any third party.

Some of the technology platforms we use to operate our business (including cloud storage, applicant tracking, and communication tools) may store or process data on servers located outside Australia, including in the United States and European Union. Where personal information is disclosed to overseas recipients, we take reasonable steps to ensure those recipients handle it in a manner consistent with the APPs.

Third Parties

Where we receive your personal information from a third party (such as a referral, a job board, or a professional networking platform), we will take reasonable steps to ensure you are made aware of this, and that the information is handled in accordance with this policy. We do not guarantee the privacy practices of third-party websites or platforms that may be linked from our website.

Security of Personal Information

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure. Our security measures include:

  • Role-based access controls limiting who within our team can access candidate and client records

  • Staff awareness of privacy obligations

Candidate files and records relating to placements will generally be retained for a minimum of seven years in accordance with our legal and professional obligations. When personal information is no longer needed and retention is not required by law, we will take reasonable steps to destroy or permanently de-identify it.

Access to and Correction of Your Personal Information

You may request access to the personal information we hold about you, and request that any inaccurate, incomplete, or out-of-date information be corrected. To make a request, please contact us in writing using the details in Section 9.

We will respond to access requests within a reasonable timeframe (generally within 30 days). We will not charge a fee for making an access request, but may charge a reasonable administrative fee for providing copies. We may require you to verify your identity before releasing information.

In some circumstances, we may be permitted or required by law to decline an access request. If we do so, we will explain why.
